Boss Digital Marketing – Affiliate Program

1. Agreement

 

By applying to join the Boss Digital Marketing Affiliate Program (“Program”), you (“Affiliate”) agree to these Terms & Conditions in full. Participation is entirely at our discretion, and we may accept or reject applications without explanation.

 

 

 

2. Commission Structure

 

  • Affiliates may earn 15–25% commission on the net revenue of referred clients, based on the agreed rate at the time of referral.

  • Net revenue means funds actually received by us, cleared in our bank account, and not subject to refund, reversal, dispute, or chargeback.

  • Commission is paid only on payments already received and cleared. No commission is payable on amounts invoiced but not yet paid.

 

 

 

 

3. Payment Terms

 

  • Commissions will be calculated weekly and paid only on cleared funds received in the prior week.

  • No future payments are guaranteed. If a referred client stops paying for any reason — including but not limited to budget changes, platform issues (Shopify, Facebook, etc.), ad performance drops, product fatigue, or business closure — no future commission is owed.

  • We take no responsibility for late or missed commissions caused by client delays, disputes, or third-party issues.

  • All payment processing fees, refunds, discounts, and taxes are deducted before commission is calculated.

 

 

 

 

4. Termination

 

  • We may terminate your participation in the Program at any time, for any reason, without notice.

  • Upon termination, commissions are only payable on cleared funds received before the termination date. No future commissions will be paid.

  • We are under no obligation to provide reasons for termination.

 

 

 

 

5. Affiliate Conduct

 

  • You must promote our services truthfully and lawfully. Misleading claims, spam, or breach of any advertising laws/platform rules is grounds for immediate termination and forfeiture of unpaid commissions.

  • You are solely responsible for your marketing activities, content, and compliance.

  • We take no responsibility for reputational harm, account bans, or other consequences of your promotional activities.

 

 

 

 

6. Liability Limitations

 

  • We are not liable for any loss of income, lost commissions, reputational damage, or indirect damages arising from participation in the Program.

  • Our total liability under this agreement is strictly limited to the total commissions we have actually paid you up to the date of the claim.

 

 

 

 

7. Intellectual Property

  

  • You may only use Boss Digital Marketing branding, logos, and approved promotional materials in the exact form provided by us.

  • All intellectual property remains our exclusive property and must be removed from your marketing immediately upon termination.

 

 

 

 

8. Confidentiality

 

  • Any client details, rates, strategies, or internal processes shared with you must be treated as confidential and not disclosed to third parties without written consent.

 

 

 

 

9. Governing Law

 

  • These Terms are governed by the laws of Victoria, Australia, and any disputes will be resolved exclusively in the courts of Victoria.
